ICOMA Mediation Rules

Our mediation proceedings operate under the ICOMA Mediation Rules, which provide a clear framework while maintaining the flexibility essential to successful mediation. These rules address confidentiality, good faith participation, authority to settle, and other critical aspects of the process.

Mediation Success Stories

While maintaining strict confidentiality regarding specific cases, we can share general examples of successful mediations:

  • Resolution of a decades-long trade dispute between major agricultural exporters
  • Settlement of a complex intellectual property conflict between technology companies
  • Agreement on operational protocols between joint venture partners from different continents
  • Consensus on compensation and future relationship between terminated distributor and manufacturer

Incorporating Mediation Clauses

ICOMA recommends including mediation clauses in international contracts to establish a clear dispute resolution framework before conflicts arise. We provide model clauses that can be easily adapted to specific circumstances:

  • Any dispute arising out of or in connection with this contract shall first be referred to mediation under the Mediation Rules of the International Court of Mediation and Arbitration (ICOMA). If the dispute has not been settled pursuant to the said Rules within [30/60] days following the filing of a Request for Mediation or within such other period as the parties may agree in writing, such dispute shall thereafter be finally resolved by arbitration under the ICOMA Arbitration Rules.
